Ordinance to Raise Sewer Rates

AN ORDINANCE FURTHER AMENDING ORDINANCE NO. 356 OF THE CITY OF MONTICELLO, AS PREVIOUSLY AMENDED AND ORDINANCE NO. 735, ESTABLISHING A SCHEDULE OF CHARGES TO BE MADE AND COLLECTED FOR FACILITIES AFFORDED AND SERVICES RENDERED BY THE SEWER SYSTEM OF THE CITY OF MONTICELLO; DECLARING AN EMERGENCY TO EXIST; AND FOR OTHER PURPOSES.

BE IT ORDAINED by the City Council of Monticello, Arkansas as follows:

Section 1. That section 2(c) of Ordinance No. 356 of the City of Monticello, adopted November 9, 1949, as previously amended including Ordinance No. 735, is hereby further amended to read as follows:

"(c) . Sewer service charges to be paid on account of each sewer consumer unit within the corporate limits of Monticello shall, except as here in above provided, be based on the average monthly consumption of water supplied to each consumer unit from the city water works system during the last receiving base period, in accordance with the following:

"For each consumer unit outside the corporate limits of Monticello the rate will be 150% of the rate applicable to sewer service within the corporate limits"

Section 2. Annual Review. The rates will be reviewed annually by the City Council on or before April 1 of each year.

Section 3. Emergency. That this ordinance is necessary for the provision of funds required for maintaining and improving the sanitary sewer system of the City of Monticello, which is urgently required for sanitary sewer purposes, to preserve the health and welfare of the inhabitants of the City of Monticello and others served by this sewer system. Therefore an emergency is declared to exist; and this ordinance, being immediately necessary for the preservation and protection of the public peace, health, welfare and safety, shall take effect and be in force immediately from and after its passage.
