Ordinance Raising Water Rates

AN ORDINANCE FURTHER AMENDING SECTION 2 OF ORDINANCE NO. 493 AND 770 OF THE CITY OF MONTICELLO, AS PREVIOUSLY AMENDED, ESTABLISHING SCHEDULES OF RATES OF CHARGES TO BE PAID FOR WATER SUPPLIED FROM THE CITY'S WATER SYSTEM; DECLARING AN EMERGENCY TO EXIST; AND FOR OTHER PURPOSES.

BE IT ORDAINED by the City Council of Monticello, Arkansas,as follows:

Section 1. Amended to Ordinance #493 and #770. Section 2 (a)-(f) of Ordinance No. 493 of the City of Monticello adopted on July 13, 1972, as previously amended(including by Ordinance No. 770), is hereby further amended.

*Section 2. Schedule of Water Service Rates and Minimum Charges. Water supplied from the City of Monticello's water distribution systems will be sold to consumers and paidfor by them on the basis of the following schedule of graduated rates and minimum monthly charges, applicable to the consumption of water during each month to each consumer unit:

a. The following rates shall be applicable to the water supplied to consumer units within the corporate limits of Monticello:

Quality of Water Consumed Rate Per 1,000 Gallon
For the first 2,000 gallons…………….$12.00
For all gallons in excess of 2,000………$1.80

b. The following rates shall be applicable to consumer units outside the corporate limits of Monticello:

Quality of Water Consumed Rate Per 1,000 Gallon
For the first 2,000 gallons…………….$15.75
For all gallons in excess of 2,000……….$2.65

c. The following rates shall be applicable to all water supplied to contracting water associations:

Quality of Water Consumed Rate Per 1,000 Gallon
For the first 1,000 gallons any part thereof…$1.67

d. In every case where two or more consumer units are supplied with water through a single meter, the total gallon age metered each month will be divided by the total number of such consumer units and the quotient thus obtained will be considered as a quantity of water consumed by each of such consumer units.

e. The minimum charge for each month to each consumer unit supplied with water from the city's water distribution systems shall be $12.00 for consumer units inside the corporate limits of Monticello and $15.75 for consumer units outside the corporate limits of Monticello.
f. All rates and charges above listed are exclusive of any gross receipts (sales)tax levied by the State of Arkansas or by any other taxing authority.

g. The rates will reviewed annually by the City Council on or before April 1 of each year.

Section 2. Security Deposit. Any new residential customer account of the city's water distribution system shall be required to deposit the sum of one-hundred dollars ($100.00) as a security deposit before connection to and the distribution of any water from the city's water distribution system; and, any new commercial customer account of the city's water distribution system shall be required to deposit the sum of two-hundred dollars ($200.00) as a security deposit before connection to and the distribution of any water from the city's water distribution system. "New" shall mean any account established for distribution from the city's water distribution system after the effective date of this ordinance.

Section 3. Emergency Clause. That the health, safety and welfare of the citizens of the City of Monticello require the provisions and maintenance of an adequate municipal water supply and water distribution system, and the establishment and collection of the charges provided by this ordinance are necessary for the provision and maintenance of such water supply and water distribution system. Therefore, an emergency is hereby declared to exist; in this ordinance, being necessary for the immediate preservation of the public peace, health, welfare and safety, shall take effect and be in force from and after its adoption.
